Terms of Use

1.1 Age Requirement. You must be at least 18 years of age to use Dhritam Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you may not use our Services under any circumstances.

1.2 Account Information. When you create an account or join our waitlist, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

1.3 One Account Per Person. Each individual may maintain only one Dhritam account. Creating multiple accounts to circumvent waitlist position, abuse referral programs, or gain unfair advantage is prohibited and may result in account termination.

2.1 Consumer Wellness Product. Dhritam products and services are consumer wellness products designed for general health awareness, stress monitoring, and personal wellbeing optimization. Dhritam is NOT a medical device, is NOT certified or approved by the Central Drugs Standard Control Organisation (CDSCO), the FDA, or any other medical device regulatory authority, and is NOT intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition.

2.2 Not a Substitute for Medical Advice. The data, insights, stress indices, HRV metrics, and recommendations provided by Dhritam are for informational and general wellness purposes only. They do not constitute medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional for any medical condition. Never disregard professional medical advice or delay seeking it because of information provided by Dhritam.

2.3 Emergency Situations. Dhritam is not designed for use in emergency situations and should not be relied upon to detect medical emergencies, cardiac arrhythmias, seizures, or life-threatening conditions. If you are experiencing a medical emergency, call emergency services (112 in India) immediately.

2.4 Data Accuracy. While Dhritam employs clinical-grade ECG sampling (500Hz) and validated signal processing algorithms, we do not guarantee the absolute accuracy, completeness, or reliability of any physiological data, stress index, or health insight produced by our products. Consumer-grade wearable data is inherently subject to motion artifacts, electrode contact variability, environmental interference, and individual physiological differences.

3.1 Free to Join. Joining the Dhritam waitlist is completely free. No payment information is collected at the time of waitlist registration. No financial obligation is created by joining the waitlist.

3.2 No Guarantee. Waitlist position does not guarantee product availability, delivery timeline, or pricing. Product availability is subject to manufacturing capacity, regulatory approvals, and business conditions. We reserve the right to modify, delay, or discontinue any product at any time.

3.3 Indicative Pricing. All pricing displayed on the website (including the stated range of INR 10,000-15,000 for Kavach X) is indicative and subject to change. Final pricing will be confirmed at the time of order placement. Early access pricing, once confirmed and paid, will be honored as stated.

3.4 Referral Program. Waitlist referral codes are provided for organic sharing only. Use of referral codes in spam, bulk messaging, paid advertising, or misleading promotions is prohibited and may result in disqualification from the waitlist and referral benefits.

4.1 Ownership. All content, features, functionality, designs, trademarks, trade names, logos, product names (including "Dhritam", "Kavach X", "Agna"), algorithms, software, firmware, hardware designs, documentation, and intellectual property displayed on or embodied in the Services are the exclusive property of Dhritam Wearable Technologies and are protected under Indian intellectual property laws, including the Copyright Act, 1957; the Trade Marks Act, 1999; the Patents Act, 1970; and the Designs Act, 2000.

4.2 Patent. Dhritam has filed a provisional patent application with the Indian Patent Office (March 2026) covering 12 independent claims related to the garment-integrated ECG acquisition pipeline, the neuro-cardiac correlation engine, and the adaptive binaural audio response system. Any unauthorized reproduction, reverse engineering, or commercial exploitation of our patented technology is strictly prohibited.

4.3 Limited License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or information obtained from our Services.

4.4 Your Data. You retain ownership of your personal and physiological data. By using our Services, you grant Dhritam a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Services, as described in our Privacy Policy.

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation
• Submit false, misleading, or fraudulent information to the waitlist, contact forms, or any other Service
• Attempt to reverse engineer, decompile, disassemble, or derive source code from any Dhritam software, firmware, or hardware
• Circumvent, disable, or interfere with any security features of the Services
• Use automated scripts, bots, or crawlers to access the Services without prior written authorization
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Use Dhritam products on any person without their informed consent
• Resell, redistribute, or commercially exploit Dhritam products or data without written authorization
• Use Dhritam data or insights to discriminate against any individual in employment, insurance, lending, or any other context
• Interfere with or disrupt the integrity or performance of the Services or related systems

6.1 Payment Processing. All payments are processed through secure third-party payment processors compliant with PCI-DSS standards. Dhritam does not store your credit card, debit card, or UPI credentials on our servers.

6.2 Taxes. All prices displayed are exclusive of applicable taxes unless explicitly stated otherwise. Goods and Services Tax (GST) and any other applicable taxes, duties, or levies will be added at checkout as required under Indian tax law. You are responsible for paying all taxes associated with your purchase.

6.3 Currency. All prices are quoted in Indian Rupees (INR) unless otherwise specified. Currency conversion rates for international transactions are determined by your payment provider and are outside Dhritam's control.

7.1 Return Policy. Dhritam hardware products may be returned within 14 days of delivery, provided the product is in its original condition, with all packaging, accessories, and documentation intact. Return shipping costs are the responsibility of the buyer unless the product is defective.

7.2 Refund Processing. Refunds will be processed within 14 business days of receiving the returned product and verifying its condition. Refunds will be issued to the original payment method.

7.3 Warranty. Dhritam hardware products carry a limited manufacturer warranty of 12 months from the date of delivery, covering defects in materials and workmanship under normal use. The warranty does not cover damage from misuse, modification, unauthorized repair, water damage beyond rated IP specifications, or normal wear and tear of textile components.

7.4 Consumer Protection. These return and warranty terms are in addition to, and do not limit, your rights under the Consumer Protection Act, 2019.

8.1 No Liability for Health Outcomes. To the maximum extent permitted by applicable law, Dhritam shall not be liable for any health outcomes, medical decisions, or clinical interpretations made based on data or insights provided by our products and services. Our products are consumer wellness tools, not medical devices.

8.2 Limitation. In no event shall Dhritam, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Services.

8.3 Maximum Liability. Our total aggregate liability for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid to Dhritam in the 12 months preceding the claim, or (b) INR 10,000.

8.4 Force Majeure. Dhritam shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to natural disasters, pandemic, war, terrorism, government action, supply chain disruptions, semiconductor shortages, or internet infrastructure failures.

10.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

10.2 Jurisdiction. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.

10.3 Arbitration. Before initiating formal legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days. If negotiation fails, disputes may be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, conducted in Ahmedabad, Gujarat, in the English language.

10.4 Consumer Forum. Nothing in these Terms limits your right to file a complaint with the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.

11.1 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

11.2 Entire Agreement. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Dhritam regarding the Services and supersede all prior agreements and understandings.

11.3 Waiver. Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or the right to enforce it.

11.4 Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

11.5 Modifications. We reserve the right to modify these Terms at any time. Material changes will be notified via email and website notice at least 15 days before taking effect.
